富味鄉起訴6人 建請沒收3億

（中央社記者陳淑芬、林恆立彰化31日電）彰化地檢署偵辦富味鄉黑麻油涉摻偽案，今天偵結，起訴董事長陳文南等6人，並請法院沒收犯罪所得新台幣3億多元。

彰化地檢署起訴書指出，富味鄉董事長兼總經理陳文南、技術總監陳瑞禮、研發中心經理林瑞聰、資材課課長劉騏瑋等6人，自民國98年12月起，製造「頂級100%黑麻油」、「特級100%黑麻油」、「高級100%黑麻油」等3款油品內，分別攙入比例不等的黃麻油、特黑油銷售。

富味鄉公司近4年期間銷售3款油品，不法總獲利新台幣3億零50萬元，陳文南等6人觸犯食品衛生管理法及詐欺取財罪嫌，3款油品的製造屬於不同詐欺罪，分論併罰。

檢察官因審酌陳文南及陳瑞禮2人犯後主動提出高額擔保金供消費者退費，極力彌補事端，建請法院適度量刑；而林瑞德等4人士聽從指示製造油品，建請從輕量刑。至於犯罪所得3億多元則建請法院宣告沒收。1021031
